Collaborative Divorce Process

Collaborative divorce is more than just meeting, casually negotiating and signing an agreement. Rather, it is a specific process that involves unique training and guidelines. 

In the collaborative divorce process, each party is represented by their own attorney, accompanied by two neutral experts: a financial professional and a mental health professional, who serves as a parenting and communication coach. With this team, the couple is provided with a dignified approach to separation while minimizing the emotional and financial expense that often coincides with divorce.

Each party works with their own attorney and signs an agreement stating that they agree to participate in the collaborative process and not go to court – which will result in a negotiated settlement. You will each freely and fully exchange information, acknowledge priorities and seek mutually acceptable solutions.

Instead of relying on a mediator or court, you will have a team of professionals who will guide you, including:

  • Your lawyer and your spouse’s lawyer. Each party has their own separate advocate. It is important to work with an attorney who has specific training and experience in the collaborative divorce process.
  • A mental health professional as a facilitator. Emotional conflicts are a natural part of divorce. A mental health professional can step in to neutralize tension and coach you through difficult issues. They can also advise you regarding co-parenting and your children’s well-being. 
  • A financial specialist. This neutral specialist will gather data, keep records and model different scenarios to help you make insightful decisions for your future.  The financial specialist does not choose sides; they strive to help the family find the best outcome for everyone. Because they transparently serve both parties, you can save money instead of hiring separate financial specialists. 
  • Other neutral resources as necessary. We can draw upon other trusted resources through our network to best suit your individual needs.
